II. The rights of users and data subjects
With regard to the data processing to be described in more detail below, users and data subjects have the right
to confirmation of whether data concerning them is being processed, information about the data being processed, further information about the nature of the data processing, and copies of the data (cf. also Art. 15 GDPR);
to correct or complete incorrect or incomplete data (cf. also Art. 16 GDPR);
to the immediate deletion of data concerning them (cf. also Art. 17 DSGVO), or, alternatively, if further processing is necessary as stipulated in Art. 17 Para. 3 GDPR, to restrict said processing per Art. 18 GDPR;
to receive copies of the data concerning them and/or provided by them and to have the same transmitted to other providers/controllers (cf. also Art. 20 GDPR);
to file complaints with the supervisory authority if they believe that data concerning them is being processed by the controller in breach of data protection provisions (see also Art. 77 GDPR).
In addition, the controller is obliged to inform all recipients to whom it discloses data of any such corrections, deletions, or restrictions placed on processing the same per Art. 16, 17 Para. 1, 18 GDPR. However, this obligation does not apply if such notification is impossible or involves a disproportionate effort. Nevertheless, users have a right to information about these recipients.
Likewise, under Art. 21 GDPR, users and data subjects have the right to object to the controller's future processing of their data pursuant to Art. 6 Para. 1 lit. f) GDPR. In particular, an objection to data processing for the purpose of direct advertising is permissible.
III. Information about the data processing
Your data processed when using our website and application will be deleted or blocked as soon as the purpose for its storage ceases to apply, provided the deletion of the same is not in breach of any statutory storage obligations or unless otherwise stipulated below.


Log data
When you visit our application or website, our servers may automatically log the standard data provided by your web browser. This data is considered “non-identifying information”, as it does not personally identify you on its own. It may include your computer’s Internet Protocol (IP) address, your browser type and version, the pages you visit, the time and date of your visit, the time spent on each page, and other details.

Data processing and storage

We only retain personal information for as long as necessary to provide a service, or to improve our services in future. If you request your personal information be deleted, or where your personal information becomes no longer relevant to our operations, we will erase it from our system within a reasonable timeframe.


Server data
For technical reasons, the following data sent by your internet browser or VR application to us or to our server provider will be collected, especially to ensure a secure and stable website and application: These server log files record the type and version of your browser, operating system, the website and application from which you came (referrer URL), the webpages on our site visited, the date and time of your visit, as well as the IP address from which you visited our site.
The data thus collected will be temporarily stored, but not in association with any other of your data.
The basis for this storage is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the improvement, stability, functionality, and security of our website and application.
The data will be deleted within no more than seven days, unless continued storage is required for evidentiary purposes. In which case, all or part of the data will be excluded from deletion until the investigation of the relevant incident is finally resolved.

You may revoke your prior consent to the processing of your personal data at any time under Art. 7 Para. 3 GDPR with future effect. All you have to do is inform us that you are revoking your consent.


The data previously collected will then be deleted as soon as processing is no longer necessary. However, we must observe any retention periods required under tax and commercial law.
Newsletter
If you register for our free newsletter, the data requested from you for this purpose, i.e. your email address and, optionally, your name and address, will be sent to us. We also store the IP address of your computer and the date and time of your registration. During the registration process, we will obtain your consent to receive this newsletter and the type of content it will offer, with reference made to this privacy policy. Contact
If you contact us via email or the contact form, the data you provide will be used for the purpose of processing your request. We must have this data in order to process and answer your inquiry; otherwise we will not be able to answer it in full or at all.
The legal basis for this data processing is Art. 6 Para. 1 lit. b) GDPR.
Your data will be deleted once we have fully answered your inquiry and there is no further legal obligation to store your data, such as if an order or contract resulted therefrom.
User posts, comments, and ratings
We offer you the opportunity to post questions, answers, opinions, and ratings on our website and application, hereinafter referred to jointly as "posts." If you make use of this opportunity, we will process and publish your post, the date and time you submitted it, and any pseudonym you may have used.


The legal basis for this is Art. 6 Para. 1 lit. a) GDPR. You may revoke your prior consent under Art. 7 Para. 3 GDPR with future effect. All you have to do is inform us that you are revoking your consent.


In addition, we will also process your IP address and email address. The IP address is processed because we might have a legitimate interest in taking or supporting further action if your post infringes the rights of third parties and/or is otherwise unlawful.
In this case, the legal basis is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in any legal defense we may have to mount.


Follow-up comments
If you make posts on our website within our application, we also offer you the opportunity to subscribe to any subsequent follow-up comments made by third parties. In order to be able to inform you about these follow-up comments, we will need to process your email address.
The legal basis for this is Art. 6 Para. 1 lit. a) GDPR. You may revoke your prior consent to this subscription under Art. 7 Para. 3 GDPR with future effect. All you have to do is inform us that you are revoking your consent or click on the unsubscribe link contained in each email.

Playfab


We use Playfab as our Account Management Service. Personal Information collected by the third-party platform that you use to access the application is subject to the applicable third-party terms of use and/or privacy policy (for more information, please see the Playfab Privacy Policy at https://playfab.com/privacy).




Oculus


We may automatically receive your personal information from the platform through which you downloaded and play the application. Personal Information collected by the third-party platform that you use to access the Game is subject to the applicable third-party terms of use and/or privacy policy (for more information, please see the Oculus Privacy Policy at https://www.oculus.com/legal/privacy-policy)




Google Analytics
We use Google Analytics on our website and application. This is a web analytics service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 (hereinafter: Google).

We use YouTube in its advanced privacy mode to show you videos. The legal basis is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in improving the quality of our website and application. According to YouTube, the advanced privacy mode means that the data specified below will only be transmitted to the YouTube server if you actually start a video.
Without this mode, a connection to the YouTube server in the USA will be established as soon as you access any of our webpages on which a YouTube video is embedded.
This connection is required in order to be able to display the respective video on our website and application within your browser or VR application. YouTube will record and process at a minimum your IP address, the date and time the video was displayed, as well as the website and application you visited / used. In addition, a connection to the DoubleClick advertising network of Google is established.


If you are logged in to YouTube when you access our site, YouTube will assign the connection information to your YouTube account. To prevent this, you must either log out of YouTube before visiting our site or make the appropriate settings in your YouTube account.
For the purpose of functionality and analysis of usage behavior, YouTube permanently stores cookies on your device via your browser. We offer you the opportunity to apply for jobs with our company via our website and application. In the case of these digital applications, we collect your application data electronically in order to process your application.
The legal basis for this processing is §26 Para. 1 S. 1 BDSG in conjunction with Art. 88 Para. 1 GDPR.


If you are hired as a result of the application process, we will store the data you provide during the application process in your personnel file for the purpose of the usual organizational and administrative process, naturally in compliance with further legal obligations.

We take security seriously, and do what we can within commercially acceptable means to protect your child’s personal information from loss or theft, as well as unauthorised access, disclosure, copying, use or modification. That said, we advise that no method of electronic transmission or storage is 100% secure, and cannot guarantee absolute data security.
Information abuse and community misconduct
We do not tolerate doxing (publishing of private or personal information about an individual without their consent), cyberbullying, or other forms of information abuse on http://www.noysvr.com.


If we discover that a child’s personal information has been disclosed on our site without the express consent of their parent/guardian, we will remove the content in question as quickly as possible and effect disciplinary measures (a warning, suspension or ban) on the offending account.


Third-party access to information

II. Rechte der Nutzer und Betroffenen
Mit Blick auf die nachfolgend noch näher beschriebene Datenverarbeitung haben die Nutzer und Betroffenen das Recht
auf Bestätigung, ob sie betreffende Daten verarbeitet werden, auf Auskunft über die verarbeiteten Daten, auf weitere Informationen über die Datenverarbeitung sowie auf Kopien der Daten (vgl. auch Art. 15 DSGVO);
auf Berichtigung oder Vervollständigung unrichtiger bzw. unvollständiger Daten (vgl. auch Art. 16 DSGVO);
auf unverzügliche Löschung der sie betreffenden Daten (vgl. auch Art. 17 DSGVO), oder, alternativ, soweit eine weitere Verarbeitung gemäß Art. 17 Abs. 3 DSGVO erforderlich ist, auf Einschränkung der Verarbeitung nach Maßgabe von Art. 18 DSGVO;
auf Erhalt der sie betreffenden und von ihnen bereitgestellten Daten und auf Übermittlung dieser Daten an andere Anbieter/Verantwortliche (vgl. auch Art. 20 DSGVO);
auf Beschwerde gegenüber der Aufsichtsbehörde, sofern sie der Ansicht sind, dass die sie betreffenden Daten durch den Anbieter unter Verstoß gegen datenschutzrechtliche Bestimmungen verarbeitet werden (vgl. auch Art. 77 DSGVO).
Darüber hinaus ist der Anbieter dazu verpflichtet, alle Empfänger, denen gegenüber Daten durch den Anbieter offengelegt worden sind, über jedwede Berichtigung oder Löschung von Daten oder die Einschränkung der Verarbeitung, die aufgrund der Artikel 16, 17 Abs. 1, 18 DSGVO erfolgt, zu unterrichten. Diese Verpflichtung besteht jedoch nicht, soweit diese Mitteilung unmöglich oder mit einem unverhältnismäßigen Aufwand verbunden ist. Unbeschadet dessen hat der Nutzer ein Recht auf Auskunft über diese Empfänger.
Ebenfalls haben die Nutzer und Betroffenen nach Art. 21 DSGVO das Recht auf Widerspruch gegen die künftige Verarbeitung der sie betreffenden Daten, sofern die Daten durch den Anbieter nach Maßgabe von Art. 6 Abs. 1 lit. f) DSGVO verarbeitet werden. Insbesondere ist ein Widerspruch gegen die Datenverarbeitung zum Zwecke der Direktwerbung statthaft.
III. Informationen zur Datenverarbeitung
Ihre bei Nutzung unseres Internetauftritts sowie Applikation verarbeiteten Daten werden gelöscht oder gesperrt, sobald der Zweck der Speicherung entfällt, der Löschung der Daten keine gesetzlichen Aufbewahrungspflichten entgegenstehen und nachfolgend keine anderslautenden Angaben zu einzelnen Verarbeitungsverfahren gemacht werden.


Serverdaten
Aus technischen Gründen, insbesondere zur Gewährleistung eines sicheren und stabilen Internetauftritts sowie Applikation, werden Daten durch Ihren Internet-Browser an uns bzw. an unseren Webspace-Provider übermittelt. Mit diesen sog. Server-Logfiles werden u.a. Typ und Version Ihres Internetbrowsers, das Betriebssystem, die Website and Applikation, von der aus Sie auf unseren Internetauftritt gewechselt haben (Referrer URL), die Website oder Szene unseres Internetauftritt oder Applikation, die Sie besuchen, Datum und Uhrzeit des jeweiligen Zugriffs sowie die IP-Adresse des Internetanschlusses, von dem aus die Nutzung unseres Internetauftritt und Applikation erfolgt, erhoben.
Diese so erhobenen Daten werden vorrübergehend gespeichert, dies jedoch nicht gemeinsam mit anderen Daten von Ihnen.
Diese Speicherung erfolgt auf der Rechtsgrundlage von Art. 6 Abs. 1 lit. f) DSGVO. Unser berechtigtes Interesse liegt in der Verbesserung, Stabilität, Funktionalität und Sicherheit unseres Internetauftritts und Applikation.
Die Daten werden spätestens nach sieben Tage wieder gelöscht, soweit keine weitere Aufbewahrung zu Beweiszwecken erforderlich ist. Andernfalls sind die Daten bis zur endgültigen Klärung eines Vorfalls ganz oder teilweise von der Löschung ausgenommen.


Cookies
a) Sitzungs-Cookies/Session-Cookies
Wir verwenden mit unserem Internetauftritt und Applikation sog. Cookies. Cookies sind kleine Textdateien oder andere Speichertechnologien, die durch den von Ihnen eingesetzten Internet-Browser auf Ihrem Endgerät ablegt und gespeichert werden. Durch diese Cookies werden im individuellen Umfang bestimmte Informationen von Ihnen, wie beispielsweise Ihre Browser- oder Standortdaten oder Ihre IP-Adresse, verarbeitet.
Durch diese Verarbeitung wird unser Internetauftritt und Applikation benutzerfreundlicher, effektiver und sicherer, da die Verarbeitung bspw. die Wiedergabe unseres Internetauftrittes und Applikation in unterschiedlichen Sprachen oder das Angebot einer Warenkorbfunktion ermöglicht.

Falls die Verarbeitung nicht der Vertragsanbahnung oder Vertragsabwicklung dient, liegt unser berechtigtes Interesse in der Verbesserung der Funktionalität unseres Internetauftrittes und Applikation. Rechtsgrundlage ist in dann Art. 6 Abs. 1 lit. f) DSGVO.
Mit Schließen Ihres Internet-Browsers oder Applikation werden diese Session-Cookies gelöscht.


b) Drittanbieter-Cookies
Gegebenenfalls werden mit unserem Internetauftritt und Applikation auch Cookies von Partnerunternehmen, mit denen wir zum Zwecke der Werbung, der Analyse oder der Funktionalitäten unseres Internetauftrittes und Applikation zusammenarbeiten, verwendet.

c) Beseitigungsmöglichkeit

Kundenkonto / Registrierungsfunktion
Falls Sie über unseren Internetauftritt und Applikation ein Kundenkonto bei uns anlegen, werden wir die von Ihnen bei der Registrierung eingegebenen Daten (also bspw. Ihren Namen, Ihre Anschrift oder Ihre E-Mail-Adresse) ausschließlich für vorvertragliche Leistungen, für die Vertragserfüllung oder zum Zwecke der Kundenpflege (bspw. um Ihnen eine Übersicht über Ihre bisherigen Bestellungen bei uns zur Verfügung zu stellen oder um Ihnen die sog. Merkzettelfunktion anbieten zu können) erheben und speichern. Gleichzeitig speichern wir dann die IP-Adresse und das Datum Ihrer Registrierung nebst Uhrzeit. Eine Weitergabe dieser Daten an Dritte erfolgt natürlich nicht.


Im Rahmen des weiteren Anmeldevorgangs wird Ihre Einwilligung in diese Verarbeitung eingeholt und auf diese Datenschutzerklärung verwiesen. Die dabei von uns erhobenen Daten werden ausschließlich für die Zurverfügungstellung des Kundenkontos verwendet.
Soweit Sie in diese Verarbeitung einwilligen, ist Art. 6 Abs. 1 lit. a) DSGVO Rechtsgrundlage für die Verarbeitung.
Sofern die Eröffnung des Kundenkontos zusätzlich auch vorvertraglichen Maßnahmen oder der Vertragserfüllung dient, so ist Rechtsgrundlage für diese Verarbeitung auch noch Art. 6 Abs. 1 lit.


b) DSGVO.
Die uns erteilte Einwilligung in die Eröffnung und den Unterhalt des Kundenkontos können Sie gemäß Art. 7 Abs. 3 DSGVO jederzeit mit Wirkung für die Zukunft widerrufen. Hierzu müssen Sie uns lediglich über Ihren Widerruf in Kenntnis setzen.
Die insoweit erhobenen Daten werden gelöscht, sobald die Verarbeitung nicht mehr erforderlich ist. Hierbei müssen wir aber steuer- und handelsrechtliche Aufbewahrungsfristen beachten.
Newsletter
Falls Sie sich für unseren kostenlosen Newsletter anmelden, werden die von Ihnen hierzu abgefragten Daten, also Ihre E-Mail-Adresse sowie - optional - Ihr Name und Ihre Anschrift, an uns übermittelt. Gleichzeitig speichern wir die IP-Adresse des Internetanschlusses von dem aus Sie auf unseren Internetauftritt und Applikation zugreifen sowie Datum und Uhrzeit Ihrer Anmeldung. Im Rahmen des weiteren Anmeldevorgangs werden wir Ihre Einwilligung in die Übersendung des Newsletters einholen, den Inhalt konkret beschreiben und auf diese Datenschutzerklärung verwiesen. Die dabei erhobenen Daten verwenden wir ausschließlich für den Newsletter-Versand – sie werden deshalb insbesondere auch nicht an Dritte weitergegeben.

Wir bieten Ihnen an, auf unseren Internetseiten Fragen, Antworten, Meinungen oder Bewertungen, nachfolgend nur „Beiträge genannt, zu veröffentlichen. Sofern Sie dieses Angebot in Anspruch nehmen, verarbeiten und veröffentlichen wir Ihren Beitrag, Datum und Uhrzeit der Einreichung sowie das von Ihnen ggf. genutzte Pseudonym.
Rechtsgrundlage hierbei ist Art. 6 Abs. 1 lit. a) DSGVO. Die Einwilligung können Sie gemäß Art. 7 Abs. 3 DSGVO jederzeit mit Wirkung für die Zukunft widerrufen. Hierzu müssen Sie uns lediglich über Ihren Widerruf in Kenntnis setzen.

Der Dienst Google Analytics dient zur Analyse des Nutzungsverhaltens unseres Internetauftritts und Applikation. Rechtsgrundlage ist Art. 6 Abs. 1 lit. f) DSGVO. Unser berechtigtes Interesse liegt in der Analyse, Optimierung und dem wirtschaftlichen Betrieb unseres Internetauftrittes und Applikation.


Nutzungs- und nutzerbezogene Informationen, wie bspw. IP-Adresse, Ort, Zeit oder Häufigkeit des Besuchs unseres Internetauftrittes und Applikation, werden dabei an einen Server von Google in den USA übertragen und dort gespeichert. Allerdings nutzen wir Google Analytics mit der sog. Anonymisierungsfunktion. Durch diese Funktion kürzt Google die IP-Adresse schon innerhalb der EU bzw. des EWR.


Die so erhobenen Daten werden wiederum von Google genutzt, um uns eine Auswertung über den Besuch unseres Internetauftrittes und Applikation sowie über die dortigen Nutzungsaktivitäten zur Verfügung zu stellen. Dabei teilt das Add-on dem JavaScript (ga.js) von Google Analytics mit, dass Informationen zum Besuch unseres Internetauftrittes und Applikation nicht an Google Analytics übermittelt werden sollen. In unserem Internetauftritt und Applikation setzen wir das Plug-in des Social-Networks Facebook ein. Bei Facebook handelt es sich um einen Internetservice der facebook Inc., 1601 S. In unserem Internetauftritt und Applikation setzen wir YouTube ein. Hierbei handelt es sich um ein Videoportal der YouTube LLC., 901 Cherry Ave., 94066 San Bruno, CA, USA, nachfolgend nur „YouTube“ genannt.
YouTube ist ein Tochterunternehmen der Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, nachfolgend nur „Google“ genannt.

Wir nutzen YouTube im Zusammenhang mit der Funktion „Erweiterter Datenschutzmodus“, um Ihnen Videos anzeigen zu können. Rechtsgrundlage ist Art. 6 Abs. 1 lit. f) DSGVO. Unser berechtigtes Interesse liegt in der Qualitätsverbesserung unseres Internetauftrittes und Applikation. Die Funktion „Erweiterter Datenschutzmodus“ bewirkt laut Angaben von YouTube, dass die nachfolgend noch näher bezeichneten Daten nur dann an den Server von YouTube übermittelt werden, wenn Sie ein Video auch tatsächlich starten.
Ohne diesen „Erweiterten Datenschutz“ wird eine Verbindung zum Server von YouTube in den USA hergestellt, sobald Sie eine unserer Internetseiten, auf der ein YouTube-Video eingebettet ist, aufrufen.


Diese Verbindung ist erforderlich, um das jeweilige Video auf unserer Internetseite über Ihren Internet-Browser darstellen zu können. Im Zuge dessen wird YouTube zumindest Ihre IP-Adresse, das Datum nebst Uhrzeit sowie die von Ihnen besuchte Internetseite erfassen und verarbeiten. Zudem wird eine Verbindung zu dem Werbenetzwerk „DoubleClick“ von Google hergestellt.
Sollten Sie gleichzeitig bei YouTube eingeloggt sein, weist YouTube die Verbindungsinformationen Ihrem YouTube-Konto zu. Wenn Sie das verhindern möchten, müssen Sie sich entweder vor dem Besuch unseres Internetauftrittes und Applikation bei YouTube ausloggen oder die entsprechenden Einstellungen in Ihrem YouTube-Benutzerkonto vornehmen.
Zum Zwecke der Funktionalität sowie zur Analyse des Nutzungsverhaltens speichert YouTube dauerhaft Cookies über Ihren Internet-Browser auf Ihrem Endgerät. Online-Stellenbewerbungen / Veröffentlichung von Stellenanzeigen
Wir bieten Ihnen die Möglichkeit an, sich bei uns über unseren Internetauftritt und Applikation bewerben zu können. Bei diesen digitalen Bewerbungen werden Ihre Bewerber- und Bewerbungsdaten von uns zur Abwicklung des Bewerbungsverfahrens elektronisch erhoben und verarbeitet.


Rechtsgrundlage für diese Verarbeitung ist § 26 Abs. 1 S. 1 BDSG i.V.m. Art. 88 Abs. 1 DSGVO.
Sofern nach dem Bewerbungsverfahren ein Arbeitsvertrag geschlossen wird, speichern wir Ihre bei der Bewerbung übermittelten Daten in Ihrer Personalakte zum Zwecke des üblichen Organisations- und Verwaltungsprozesses – dies natürlich unter Beachtung der weitergehenden rechtlichen Verpflichtungen.
Rechtsgrundlage für diese Verarbeitung ist ebenfalls § 26 Abs. 1 S. 1 BDSG i.V.m. Art. 88 Abs. 1 DSGVO.


Bei der Zurückweisung einer Bewerbung löschen wir die uns übermittelten Daten automatisch zwei Monate nach der Bekanntgabe der Zurückweisung. Die Löschung erfolgt jedoch nicht, wenn die Daten aufgrund gesetzlicher Bestimmungen, bspw. wegen der Beweispflichten nach dem AGG, eine längere Speicherung von bis zu vier Monaten oder bis zum Abschluss eines gerichtlichen Verfahrens erfordern.
Rechtsgrundlage ist in diesem Fall Art. 6 Abs. 1 lit. f) DSGVO und § 24 Abs. 1 Nr. 2 BDSG. Unser berechtigtes Interesse liegt in der Rechtsverteidigung bzw. -durchsetzung.
